By accessing or using HomeHero AI, Inc.'s website and platform (the "Platform"), you agree to these Terms and Conditions ("Terms"). Please read them carefully before using the Platform. If you do not agree to these Terms, you may not use the Platform.

HomeHero AI provides an AI-powered online platform that enables home sellers ("Users") to receive intelligent guidance and automation support through the entire home selling process, including handling tedious tasks such as document preparation, market analysis, listing optimization, and workflow management.

HomeHero AI acts as a technology provider of AI tools and informational guidance, working alongside licensed real estate brokers who oversee transactions. HomeHero AI is not a licensed attorney, financial advisor, or escrow agent. All AI outputs are for informational purposes only and do not constitute legal or financial advice. Users remain solely responsible for all decisions, compliance with applicable real estate laws, and the ultimate outcome of any home sale. Users should consult licensed professionals before relying on any Platform guidance.

HomeHero AI does not guarantee the accuracy, completeness, timeliness, or suitability of any AI-generated guidance, market data, document templates, or automation features. Users are solely responsible for:

• Verifying all information, complying with local, state, and federal real estate laws, and ensuring the legality of their selling activities.
• The quality, accuracy, and outcome of any home sale or transaction.

Any issues, disputes, or losses arising from the sale of a home (including buyer disputes, title problems, pricing, or legal compliance) must be resolved directly by the User with the relevant third parties (buyers, agents, attorneys, title companies, etc.). HomeHero AI bears no responsibility for such matters.

Users must be at least 18 years old and legally authorized to sell the property in question. By using the Platform, you represent that you meet these requirements and that all information you provide is truthful and accurate.

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. HomeHero AI reserves the right to suspend or terminate accounts for violation of these Terms, fraudulent activity, or misuse of the AI tools.

The Platform may offer free and paid features, subscriptions, or premium services. All purchases and subscriptions are final unless otherwise stated in the specific offer. The monetary transaction occurs directly between the User and HomeHero AI.

Refunds are not guaranteed and are issued only at HomeHero AI's sole discretion or as required by applicable consumer protection laws. HomeHero AI is not obligated to issue refunds for any reason related to the outcome of a home sale or dissatisfaction with AI guidance.

All content, design, software, AI models, data outputs, and materials on the Platform remain the exclusive property of HomeHero AI, Inc. or its licensors. Users may not copy, distribute, modify, reverse-engineer, or create derivative works without prior written permission.

Users may not:

• Use the Platform for any unlawful purpose or in violation of real estate regulations.
• Generate or upload false, misleading, or fraudulent property information.
• Attempt to interfere with or compromise the Platform's functionality, security, or AI systems.
• Misrepresent their identity or authorization to sell any property.

Violations may result in immediate account suspension or termination and potential legal action.

HomeHero AI provides AI tools "as is" and makes no representations or warranties (express or implied) regarding the accuracy of AI outputs, success of any home sale, market data, document templates, or any other feature.

To the fullest extent permitted by law:

• HomeHero AI disclaims all liability for any damages arising from your use of the Platform, reliance on AI guidance, or the home selling process.
• All real estate decisions, transactions, and outcomes occur solely between Users and third parties.

You agree to indemnify and hold harmless HomeHero AI, Inc., its affiliates, officers, employees, and partners from any claims, liabilities, damages, or expenses arising from your use of the Platform, violation of these Terms, or any home selling activities.

HomeHero AI may update these Terms at any time. Changes become effective when posted on the Platform. Continued use after any modification constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware and applicable federal laws of the United States, without regard to conflict of law provisions.

HomeHero AI may require a phone number to create an account and use certain features. By providing your phone number, you consent to receive automated text messages from HomeHero AI at that number. You understand that:

• Message and data rates may apply according to your mobile carrier's plan.
• Providing your phone number and consenting to SMS is required for phone-verified features.
• If you opt out, you may lose access to phone-dependent features (see Section 5).

HomeHero AI sends SMS messages solely for account verification and security purposes.

Messages are sent only when you actively request verification:

• One code per sign-up or login attempt.
• Rate limited to a maximum of 3 codes per phone number per 15-minute period for security.

• Standard message and data rates may apply.
• HomeHero AI charges no additional fees.
• You are responsible for any carrier charges.
• International numbers may incur extra rates.

Reply "STOP" or "UNSUBSCRIBE" to any message, or contact support through the Platform.

Important: If phone verification is required for your account, opting out may prevent you from creating or accessing your account.

We use third-party providers (including Twilio). Delivery is not guaranteed and may be delayed by carrier issues.

Your phone number is stored securely and used only for authentication. Text messaging opt-in data and consent will not be sold or shared with third parties or affiliates for marketing. See our Privacy Policy for full details.

Codes expire after 10 minutes, are single-use, and are protected by rate limiting and industry-standard encryption.

Contact support through the Platform for assistance.

We may update these terms. Material changes will be posted on the Platform with a revised date. Continued use constitutes acceptance.

HomeHero AI is not responsible for carrier issues, charges, filtering, or device problems.

You must be at least 13 years old (or the age of majority in your jurisdiction) to use our SMS service.

We comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and other applicable laws.

To the maximum extent permitted by law, HomeHero AI is not liable for failed or delayed messages, inability to access your account due to SMS issues, or carrier charges.

These SMS Terms, together with the Terms of Service and Privacy Policy, form the entire agreement regarding SMS services.
